Data Privacy and AI in Business: What's Allowed, What to Watch, How to Stay Safe
"What about data privacy?" That's the question I hear at every conversation about implementing AI in business. And rightfully so. Data protection isn't just a legal requirement. It's a real business risk: penalties reaching 20 million euros or 4% of annual revenue under GDPR.
But fear of data privacy regulations shouldn't paralyze you. You can legally and safely use AI in business. You just need to know how. This article explains it without legal jargon, in business owner language.
Why Business Owners Fear AI and Data Privacy (And They're Partially Right)
The fear has three sources:
- Legal uncertainty. GDPR was created in 2018, when ChatGPT didn't exist. Regulations are still catching up with technology. The EU AI Act entered into force in 2024, but full regulations are being implemented gradually until 2027.
- High-profile penalties. Italy blocked ChatGPT in 2023. Google received a 50 million euro fine from CNIL. This creates fear.
- Lack of clear guidelines. Data protection authorities haven't yet issued detailed guidelines for AI use in SMBs.
But lack of guidelines doesn't mean prohibition. It means you need to act reasonably, document decisions, and apply existing data privacy principles to new tools.
What Happens to Your Data in ChatGPT, Gemini, and Copilot
Before we get to the rules, you need to understand how these tools work "under the hood." In plain terms:
ChatGPT (Free and Plus)
- By default: your conversations may be used for model training
- You can disable this in settings (Data Controls → Improve the model → Off)
- Even after disabling, data is stored for 30 days "for safety reasons"
- Servers in the USA. Data leaves the EU.
ChatGPT Team / Enterprise
- Data is NOT used for model training
- Data isolation between organizations
- SOC 2 Type II compliance
- DPA (Data Processing Agreement) available
- Still US servers, but with appropriate legal safeguards
Microsoft 365 Copilot
- Data processed within your Microsoft 365 organization
- EU servers (if you've configured M365 that way)
- Data doesn't leave your M365 instance
- DPA already built into the Microsoft agreement
- Best option for data privacy for companies already using Microsoft
Google Gemini (Workspace)
- In Workspace version: data is not used for training
- Data in EU (if region set to Europe)
- DPA available as part of Google Workspace agreement
What You Should ABSOLUTELY NOT Enter into AI Tools
This is the most important section of this article. Regardless of which tool you use, never enter:
- Social security numbers, tax IDs of clients (unless you have a DPA with the provider)
- Client personal data (name, address, phone, email in an identifiable context)
- Medical data (test results, diagnoses, treatment history)
- Financial data (account numbers, credit cards, balances)
- Trade secrets (formulas, pricing strategies, contracts with key clients)
- Passwords and login credentials
What you CAN safely enter:
- Marketing texts, email drafts (without personal data)
- General questions about business processes
- Requests to summarize content (after removing personal data)
- Generating document templates
- Market trend analyses
- Presentation drafts
How to Legally Implement AI While Respecting Data Privacy: 7 Steps
Step 1: Choose a Tool with the Right Level of Security
Not every AI tool is equal. For a company processing personal data, the minimum requirement is ChatGPT Team, Microsoft 365 Copilot, or Google Gemini Workspace. The free version of ChatGPT is NOT suitable for work with client data.
Step 2: Sign a Data Processing Agreement (DPA)
A DPA is a document required by GDPR when an external entity processes personal data on your behalf. Good AI tools (ChatGPT Enterprise, M365 Copilot) offer DPAs as standard. Check if you have one signed.
Step 3: Determine the Legal Basis for Processing
Data privacy law requires you to have a legal basis for processing data. In the context of AI, this is usually:
- Legitimate interest. Automating customer service, improving internal processes.
- Contract performance. If AI helps you deliver a service to a client.
- Consent. If the client explicitly agrees to their data being processed by AI (e.g., chatbot on your website).
Step 4: Create an Internal AI Usage Policy
A document (5-10 pages) for your employees describing:
- Which AI tools are permitted in the company
- What data can and cannot be processed
- Data anonymization procedure before entering into AI
- Who is responsible for overseeing AI usage
- Incident reporting procedure
Step 5: Train Your Team
A policy without training is just paper. Every employee using AI must know what not to enter. Training doesn't need to be long: 30-60 minutes with examples and exercises.
Step 6: Conduct a Risk Assessment (DPIA)
If you process personal data on a large scale or sensitive data, GDPR requires a Data Protection Impact Assessment (DPIA). For a small company using ChatGPT Team for email drafting: a DPIA most likely isn't required. For a company processing patients' medical data: yes, it is.
Step 7: Document Everything
GDPR operates on the principle of accountability. You must be able to prove that you've taken reasonable steps. Document: what tools you use, why, what safeguards you apply, when you trained your team.

5 Questions to Ask an AI Consultant About Data Privacy
If you're considering hiring an AI consultant, ask them these questions:
- "Where will my data be processed?" Good answer: specific server location. Bad: "in the cloud."
- "Will my data be used to train AI models?" The only acceptable answer: "no."
- "Do you provide a data processing agreement?" If the consultant doesn't know what a DPA is, look elsewhere.
- "What does the data deletion procedure look like?" Data privacy law gives your clients the right to data deletion. The consultant must know how to implement this.
- "Will you help create an internal AI usage policy?" Good AI implementation = tools + processes + documentation. Not just technology.
What NOT to Fear
Finally, a few things that sound scary but aren't:
- "AI will steal my data." Business-class tools (Team/Enterprise) don't use your data for training. This is a contractual provision, not just a promise.
- "Regulators will fine me for using ChatGPT." Authorities penalize lack of safeguards and documentation, not using tools. If you have a DPA, policy, and training, you're safe.
- "I need a lawyer specializing in AI." For SMBs: no. A reasonable approach, a DPA with the provider, and an internal policy are enough. A lawyer is needed if you process sensitive data (medical, financial).
Summary
Data privacy and AI are not contradictory. You can legally and safely implement artificial intelligence in business. The key is:
- Use business-class tools (not free ChatGPT for client data)
- Sign a DPA with the provider
- Create and enforce an internal AI usage policy
- Train your team
- Document decisions
Don't let fear of data privacy regulations stop you from implementing AI. Companies that do nothing also take risks: they risk losing competitiveness.
